Welcome to HushOra. These Terms of Service (“Terms”) govern your access to and use of the HushOra website, online store, products, services, content and related features (collectively, the “Services”).
By accessing or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our Services.
HushOra is powered by Shopify, which provides the ecommerce infrastructure used to operate our online store.
1. Eligibility and Use of the Services
You must be at least the age of majority in your jurisdiction to enter into a purchase agreement with HushOra.
If you use our Services on behalf of another person or entity, you represent that you have authority to bind that person or entity to these Terms.
You agree to provide accurate, current and complete information when placing an order or otherwise interacting with our Services.
You are responsible for maintaining the confidentiality of any account credentials associated with your account and for activity conducted through your account.
You may not use our Services for any unlawful, fraudulent, abusive or unauthorized purpose.
2. Products and Product Information
We make reasonable efforts to ensure that product descriptions, images, specifications and other information displayed on our website are accurate and up to date.
However, product colors and appearance may vary depending on your device, screen settings, lighting and other factors.
Minor variations in appearance, packaging or presentation do not necessarily constitute a product defect.

Where a specific product specification is stated as part of your purchase, that specification forms part of the product information applicable to your order.
Nothing in these Terms excludes or limits any mandatory legal rights relating to product conformity, safety, warranties or consumer protection.
3. Orders and Order Acceptance
When you submit an order through our website, you are making an offer to purchase the products in your order.
After you submit your order, you will receive an order confirmation acknowledging receipt of your order. This confirmation does not necessarily mean that your order has been accepted.
Your order is accepted when we confirm that the products have been accepted for fulfillment or otherwise communicate acceptance to you.
We reserve the right to refuse or cancel an order where reasonably necessary, including in circumstances involving:
- Suspected fraud or unauthorized payment;
- Incorrect pricing or product information caused by an obvious error;

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order.
Nothing in this section limits any rights you may have under applicable consumer protection laws.
4. Pricing, Promotions and Payments
Prices displayed on our website are shown in the applicable currency and may change from time to time.
The price applicable to your order is the price displayed at checkout when you complete your purchase, except in cases of an obvious pricing or technical error.
Unless otherwise stated at checkout, applicable taxes, shipping charges, customs duties, import fees or other charges may apply depending on the destination and applicable law.
Promotions, discounts, bundles and promotional codes may be subject to additional terms.
Unless expressly stated otherwise:
- Promotional codes cannot be combined;
- Promotional offers are subject to availability;
- Promotional codes may not be exchanged for cash;
- Promotional codes may not be reproduced, sold or distributed without authorization; and
- We may limit or discontinue a promotion where permitted by law.
We use third-party payment providers to process payments. Payment information may be processed directly by those providers in accordance with their applicable terms and privacy policies.
5. Shipping and Delivery
Shipping and delivery information displayed on our website is provided as an estimate unless a specific delivery commitment is expressly stated.
Delivery times may be affected by factors outside our reasonable control, including:
- Carrier delays;
- Customs processing;
- Weather;
- Natural disasters;
- Strikes or labor disruptions;
- Government restrictions;
- Incorrect or incomplete delivery information; and
- Other events beyond our reasonable control.
Customers are responsible for providing accurate shipping information.
If an order cannot be delivered because incorrect or incomplete information was provided by the customer, additional shipping costs may apply where permitted by law.
For international orders, customs duties, import taxes and other destination charges may apply depending on the destination country. Unless expressly stated otherwise at checkout, such charges are the responsibility of the customer where applicable.

Our commercial product guarantee applies according to the terms stated in that policy.

7. Product Use and Safety
You agree to use HushOra products only for their intended purpose and in accordance with any applicable product instructions, warnings and safety information provided with the product.
You should not modify, disassemble or attempt unauthorized repairs on the product.
You are responsible for using the product with compatible electrical equipment and according to applicable safety instructions.
HushOra is not responsible for damage caused by misuse, unauthorized modification, improper installation, incompatible equipment or other use outside the product's intended purpose, to the extent permitted by applicable law.
Nothing in this section excludes liability that cannot legally be excluded.
8. Intellectual Property
All content made available through our Services, including trademarks, logos, product names, text, photographs, graphics, videos, designs, product descriptions and other materials, is owned by or licensed to HushOra and is protected by applicable intellectual property laws.
You may use the Services for personal, non-commercial purposes.
You may not reproduce, distribute, modify, copy, publish, sell, create derivative works from or commercially exploit our content without our prior written permission, except where permitted by applicable law.
All rights not expressly granted under these Terms are reserved.
9. Customer Reviews and Feedback
If you submit a review, testimonial, photograph, video, comment, suggestion or other content to HushOra (“Feedback”), you grant HushOra a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, adapt and distribute that Feedback for purposes including operating, improving and promoting our Services.
You represent that:
- You own or have permission to submit the Feedback;
- The Feedback does not infringe another person's rights;
- The Feedback is not fraudulent or misleading;
- You have disclosed any material connection or compensation associated with the Feedback where required by law; and
- The Feedback complies with applicable law.
We may remove or decline to publish Feedback that we reasonably believe violates these Terms, applicable law or another person's rights.
We do not guarantee that submitted Feedback will remain confidential.
10. Third-Party Services and Links
Our Services may contain links, integrations or functionality provided by third parties.
Third-party services are governed by their own terms and privacy policies.
We are not responsible for the availability, accuracy, security or content of third-party websites or services that we do not control.
This does not affect any mandatory rights you may have against HushOra under applicable law.
11. Shopify
HushOra uses Shopify to operate our online store.
Your purchase is a transaction between you and HushOra. Shopify provides the technology infrastructure that enables us to operate the Services.
Shopify is not responsible for the products sold by HushOra or for the contractual relationship between HushOra and its customers, except to the extent required by applicable law.
12. Privacy
Our collection and use of personal information is governed by our Privacy Policy.
13. Prohibited Activities
You may not use the Services to:
- Violate any applicable law or regulation;
- Commit fraud or facilitate fraudulent transactions;
- Use stolen or unauthorized payment information;

If an obvious error materially affects an order that has not yet been fulfilled, we may contact you to confirm whether you wish to proceed at the corrected price or cancel the affected order.
If an order is cancelled after payment, we will refund the amount paid for the cancelled portion of the order.
This section does not affect rights that cannot legally be excluded.
15. Force Majeure
We will not be responsible for delay or failure to perform an obligation where the delay or failure results from circumstances beyond our reasonable control, including natural disasters, war, terrorism, government action, widespread service outages, labor disputes, carrier disruptions, epidemics, cyber incidents affecting critical infrastructure or other events that could not reasonably have been prevented or avoided.
Where such an event occurs, we will take reasonable steps to resume performance as soon as reasonably possible.
16. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Services are provided on an “as available” basis.
We do not guarantee that the website or Services will always be uninterrupted, error-free or completely secure.
However, nothing in these Terms excludes or limits:
- Mandatory consumer guarantees;
- Statutory warranties;
- Liability that cannot legally be excluded;
- Rights relating to defective or unsafe products; or
- Any other protection that applicable law requires us to provide.
17. Limitation of Liability
To the fullest extent permitted by applicable law, HushOra will not be liable for indirect, incidental, special or consequential losses arising from the use of the Services.
However, nothing in these Terms excludes or limits liability for matters that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence where applicable, fraud or fraudulent misrepresentation, or mandatory consumer rights relating to defective or unsafe products.
Where applicable law permits a limitation of liability, our liability will be limited to the maximum extent permitted by that law.
This section does not limit any rights or remedies that you cannot legally waive.
18. Indemnification
To the extent permitted by applicable law, you agree to be responsible for losses or claims arising directly from your unlawful use of the Services, your fraud, or your material violation of these Terms.
Nothing in this section requires a consumer to indemnify HushOra for losses caused by HushOra's own unlawful conduct or for rights that cannot legally be waived.
19. Suspension and Termination
We may suspend or restrict access to the Services where reasonably necessary to:
- Protect the security of our Services;
- Prevent fraud or abuse;
- Comply with applicable law;
- Address material violations of these Terms; or
- Protect our customers, business or systems.
Termination or suspension will not affect rights or obligations that arose before termination or any rights that cannot legally be excluded.

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law, and the remaining provisions will remain in effect.
21. No Waiver
If we do not immediately enforce a provision of these Terms, that does not mean that we waive our right to enforce it later.

These Terms, together with the policies expressly incorporated into them, constitute the agreement between you and HushOra regarding your use of the Services, subject to any mandatory rights under applicable law.
23. Governing Law and Consumer Rights
These Terms are governed by the laws applicable to HushOra's place of establishment, without depriving consumers of any mandatory protections granted to them by the laws that apply to their purchase or place of residence.
Nothing in these Terms prevents a consumer from exercising rights available under mandatory consumer protection laws.
For consumers in the European Union and other jurisdictions with mandatory consumer protection rules, those protections remain unaffected.
Mandatory consumer rights cannot be waived merely by agreeing to these Terms. EU rules, for example, require consumer contracts to be fair and transparent, and unfair standard terms may not be binding on consumers.
